This Distance Sales Agreement governs the terms and conditions for the purchase and use of Contempli digital services provided by Kubert Technology through remote sales channels.

4. Pricing and Payment
Payment Terms
- Prices are displayed in US Dollars (USD) and other supported currencies
- All prices include applicable taxes
- Payment is due immediately upon subscription
- Recurring subscriptions are charged automatically

- Credit/Debit cards (Visa, MasterCard)
- Processed securely through İyzico payment gateway
- Bank transfers (where applicable)
5. Right of Withdrawal - Important Notice
Immediate Service Commencement
IMPORTANT: By completing your purchase, you expressly request that our digital services begin immediately upon payment confirmation, and you acknowledge that:
No Refund Policy
- You will receive immediate access to the Contempli platform
- Digital service delivery begins within 5 minutes of payment
- You expressly consent to immediate performance of services
- You waive your 14-day withdrawal right as provided under Turkish Distance Sales Regulation
Limited Exceptions
Refunds may only be considered for:
- Technical issues preventing service access for more than 48 hours
- Duplicate payments due to system error
- Unauthorized charges (subject to investigation)
6. Delivery and Performance
Service Delivery
- Digital services are delivered immediately upon payment
- Service activation within 5 minutes of payment
- 24/7 service availability (except maintenance)
Performance Obligations
- Provide services as described
- Maintain service quality and availability
- Provide customer support
- Ensure data security and privacy
7. Customer Obligations
- Provide accurate information during registration
- Maintain confidentiality of account credentials
- Use services in accordance with terms of service
- Pay fees on time
- Notify us of any issues promptly
8. Limitation of Liability
Our liability is limited to:
- Direct damages up to the amount paid for services
- We are not liable for indirect or consequential damages
- Force majeure events excuse performance
- Customer's exclusive remedy is service credit (no refunds)
9. Intellectual Property
- All intellectual property rights belong to Kubert Technology
- Customer receives limited license to use services
- No transfer of ownership rights
- Respect for third-party intellectual property
10. Data Protection
Personal data processing is governed by our Privacy Policy and includes:
- Compliance with Turkish data protection law
- Secure processing of payment information
- Customer rights regarding personal data
- Data retention and deletion policies
11. Dispute Resolution
Consumer Arbitration
For disputes up to the monetary limit set by regulations:
- Consumer can apply to Consumer Arbitration Committee
- Or file a lawsuit in Consumer Court
- Jurisdiction: Courts in our registered address
Applicable Law
This Agreement is governed by Turkish law and regulations.
12. Amendment and Termination
- We may modify this Agreement with 30 days notice
- Continued use constitutes acceptance of changes
- Either party may terminate with appropriate notice
- Termination obligations survive Agreement end
13. Force Majeure
Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including:
- Natural disasters
- Government actions
- Internet service disruptions
- Cyber attacks
- Pandemic or health emergencies
14. Entire Agreement
This Agreement, together with our Privacy Policy and Terms of Service, constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements.
